These terms govern your use of propertyplanco.com and the estimates and reports we provide (the "Service"), operated by The Property Plan Co., an affiliate of Brooks Capital Partners. By using the Service, you agree to them.

What the Service is — and isn't

The Property Plan provides informational estimates that compare potential paths for a property: listing as-is, accepting a cash offer, renovating and selling, or keeping it as a rental. Estimates are generated from third-party data, public records, modeling assumptions, and the information you provide, and they can be wrong or incomplete. They are not an appraisal, a broker price opinion, an offer to purchase, or financial, legal, tax, investment, or real estate advice. Actual values, rents, costs, and outcomes will differ. You are responsible for your own decisions, and we encourage you to consult licensed professionals before acting on any number in a report.

No obligation, no guarantee of an offer

Requesting an estimate or a report is free and creates no obligation for you to sell, renovate, or rent — and no obligation for us or our affiliates to make an offer, purchase a property, or provide any particular service.

Your responsibilities

You confirm that you are at least 18, that the information you submit is accurate to the best of your knowledge, and that you have a legitimate connection to any property you submit (for example, you own it, co-own it, or are helping the owner with their permission). You agree not to misuse the Service — including scraping it, probing or overloading it, submitting other people's information without authority, or using it for any unlawful purpose.

Communications

When you submit your contact information, you consent to be contacted as described at the point of submission and in our Privacy Policy. You can opt out of emails via the unsubscribe link in any message and out of texts by replying STOP.

Intellectual property

The Service, including its design, text, graphics, and reports, belongs to The Property Plan Co. or its licensors. Reports are prepared for your personal use in evaluating your property; please don't republish or resell them.

Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, The Property Plan Co., Brooks Capital Partners, and their members, managers, and employees will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits or opportunity, arising from your use of the Service, and our total liability for any claim will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You agree to indemnify us against claims arising from information you submit without authority or your misuse of the Service.

Governing law

These terms are governed by California law. Any dispute will be resolved in the state or federal courts located in San Diego County, California.

Changes

We may update these terms from time to time; the effective date above reflects the latest version. Continued use of the Service after changes means you accept them.
